This petition requests that the Board of Directors rescind their decision which allowed the use of the Monarch ball on the ORPS pickleball courts. The reasons for this request follow. The Board authorized a pickleball trial to be conducted from 1 November 2015 to 29 February 2016. Various balls were used including the Onix Foam Quiet ball. An advisory vote was approved for inclusion in the spring 2016 Board election. The advisory vote asked owners if they approved establishing pickleball courts on two contiguous tennis courts at either ES or LP, under 5 conditions. The first condition was that only the quiet ball or equivalent, as demonstrated during the pickleball trial, will be used. It is clear that the Board included this condition recognizing that sound mitigation provided by the quiet ball was necessary due to the close confines of surrounding residences and facilities and was required in order to gain the owners approval of the project. In February and March of 2019 in-house tests were conducted with alternative balls in an attempt to find a standard ball whose acoustic emissions would be equivalent to the quiet ball and included attempts to employ portable sound mitigation. These tests were not considered to be conclusive; in June 2019 the Board authorized management to contract with an acoustic consultant to carry out a pickleball sound study. The stated objective of the study was to “test sound levels on our courts using currently approved equipment to establish a baseline, alternative USAPA-approved quiet balls, and recommend sound mitigation options that could be implemented to bring sound levels of alternative balls to acceptable levels”. The USAPA-approved quiet ball was the Monarch ball. The sound study was conducted November 13, and a report was issued on December 15. The December 16 Board meeting included an agenda item to review the test results. Board members had less than 24 hours to acquaint themselves with the contents and conclusions of the report. After discussion of noise issues and possible noise mitigation, the Board approved the Monarch ball for use from 8:00 am to 4:00 pm every day. The ORPS Rules and Regulations were modified to reflect this decision on December 16, the same day as the Board’s decision. The Consultant’s report was not posted to the ORPS website for access by the owners until after this decision was made. The ORPS Covenants, Conditions and Restrictions require that prior to adopting a Rule Change, the wording of the proposed change must be posted as a general notice for 28 days to allow resort owners the opportunity to review the change and provide input to the Board. Rule changes can only be made after consideration of comments from the resort owners.
The decision should be reversed as there were a number of flaws evident in the decision process:
The Consultant’s report concluded that the Monarch ball is 5 to 7 dBA louder than the quiet ball and can not be considered as equivalent to the quiet ball. This decision therefor contravenes the first condition of the Advisory Vote. The Board made their decision without taking the time for the comprehensive review of the report required to fully understand the extent of the noise issue. The decision was made without having received from the Consultant any recommendations specific to the Monarch ball. Members had no opportunity to review the Consultant’s report and provide input before the decision was made and the Rules and Regulations revised. Members had no opportunity to review the rule change prior to its adoption as required by the resort CC&R. There is ample experience illustrating the problems that occur when pickleball facilities are constructed too close to residential areas. In ORPS case, it is not just the owners around the pickleball courts that are affected. All of the members who utilize the ES facilities share in the annoyance resulting from the pickleball noise. Disregarding this evidence will result in growing irritation and dissatisfaction among affected members, with a high probability of an expensive legal challenge.
