The BoxMaker To Acquire Tango Press In Arizona The BoxMaker, a leading digital packaging producer based in Kent, Washington, an- nounced that it has expanded its national reach with the acquisition of Springdale, Ar- izona based Tango Press. Terms of the deal were not disclosed and the parties expect closing to occur prior to the end of 2020. Tango Press opened in 2016 as an all-digi- tal production plant for corrugated packaging and displays. The company has a reputation in the marketplace for providing high-impact packaging and displays that meet customers’ unique needs, timeframe and price points. “The acquisition of Tango Press is a per- fect complement to The BoxMaker and our web-to-print brand, Fantastapack.com,” said Richard Brown, President and co-owner of The BoxMaker. “This addition gives us the opportunity to expand our reach and improve product distribution for digitally printed and finished packaging to businesses throughout the United States.” “As an all-digital production plant, Tango Press’ business model and culture are a natu- ral fit for The BoxMaker and we look forward to the expanded benefits that our combined

Founded in 1834 as the E. Murdock Co., the family-owned indepen- dent, formerly known as New England Wooden Ware, was at one time the largest manufacturer of wooden domestic products and containers in New England. NEWW transitioned from wood to corrugated packag- ing during the early 1940s and today is considered one of the premier flexographic printers in the United States. New Mexico To Invest $5M To Keep McKinley Paper Mill In Business NewMexico’s Cabinet Secretary Alicia J. Keyes announced last week that a long-time paper factory in McKinley Coun- ty will receive economic assistance from the state so it can install new equipment and remain in business for the next decade, retaining at least 125 well-paying jobs. Here is a statement from the New Mexico Economic Development Department: McKinley Paper has been reliant on the Escalante Gen- erating Station for steam power. The 253-megawatt, coal- fired power plant near Prewitt, New Mexico, operated by Tri-State Generation and Transmission Association, closed at the end of August as the facility exhausted its remaining on-site fuel supply. The State of New Mexico, through the Economic Devel- opment Department, has pledged to invest $5 million from LEDA, the Local Economic Development Act, to sustain long-term operations at McKinley Paper. The LEDA grant will go toward construction of a new boiler and associated equipment, as well as inbound water systems and waste- water treatment. The company also recycles water to use within its system. “My administration has always been committed to pre- serving jobs in the northwestern part of our state,” Gov. CONTINUED ON PAGE 38

BMO Capital Markets’ Mark Wilde: Containerboard Hike A ‘Done Deal’ According to Mark Wilde Ph.D., Paper & Packaging ana- lyst at BMO Capital Markets, the recent announcements by multiple integrateds of a $50/ton prince increase for containerboard is a “done deal,” with widespread reports of customers already ordering at the higher price. “This may be one of the least contentious price hikes in recent memory,” noted Wilde. “According to the head of an extremely well-run privately held integrated, container- board conditions are at their tightest in 25 years.” In boxboard, Sonoco, Greif and WestRock all an- nounced a $50/ton price hike for Uncoated Recycled Board (URB). Also in boxboard, WestRock announced a $50/ton Coated Unbleached Kraft Board (CUK) price hike. Fundamentals for CUK appear strong, as beverage mar- kets remain healthy, noted Wilde. Board Converting News has not yet changed the Aver- age Containerboard Prices in the chart on page 3 of this issue to reflect the increases mentioned above. As it says in the chart, “The average prices reported are tabulated from prices PAID by various sources throughout the Unit- ed States the week previous to issue.” When a majority of converter respondents surveyed report paying a high- er price and indicate what that price is, Board Converting News will adjust its pricing.

Can Employers Require Mandatory Vaccinations? BY JOEL GREENWALD

those that apply to flu vaccination and could compel a dif- ferent analysis. Is A Mandatory Flu Vaccination Policy Even Legally Per- missible? It CAN be. Absent a state or local law to the contrary, private employers are likely not prohibited from requiring employees to get a flu shot to keep the employees and the workplace safe. But as with most legal questions, there are some stipulations and limitations. The federal Occupational Safety and Health Act (OSHA) requires an employer to maintain a workplace that is free of recognized hazards. Seemingly, this would permit an employer to require the flu vaccine to help protect the workplace. However, the Americans with Disabilities Act (ADA) limits an employer’s ability to make medical-related inquires and/or conduct medical examinations of employ- ees — except in limited scenarios. Specifically, the medical exam or inquiry would need to be job-related and consis- tent with business necessity. This “necessity” would need to be based on a reasonable belief that an employee’s ability to perform essential job functions will be impaired by a medical condition, or the medical condition will pose a significant risk of substantial harm to workplace health or safety. The employer’s belief must be based on factu- al information, not just subjective perceptions or irrational fears of the medical condition. Essentially, there has to be a specific and reasonable basis to believe that requiring a

We discuss here the le- gal nuances associated with such a mandate, and things to consider before deciding to implement a mandatory vaccination policy. Neither government agencies nor the courts have yet addressed whether a COVID-19 vaccination mandate at the workplace would be lawful. Therefore, the discussion here largely relates to flu vaccination issues, which may be instructive for when a COVID-19 vaccine becomes avail- able. We do note that the circumstances, law, and guid- ance relating to a COVID-19 vaccine may be different than

Shedding Light On Electrical Safety In The Workplace BY MARY DRAIN

OSHA looks to the requirements of NFPA 70E to fulfill the performance-based requirements included in its stan- dards. NFPA 70E outlines ways to comply with OSHA’s electrical safety requirements. NFPA typically publishes updates to their standards every 3-5 years. A fact sheet created by NFPA addresses some of the major changes for the 2021 edition. These include: • Article 110 : Some requirements in Article 110 have been reorganized for a more logical progression, including moving general principles of lockout/tagout from Sec- tion 120.2 and general principles of an electrically safe work condition and energized work requirements from Section 130.2. New subsection 110.5(K) requires that an employer’s electrical safety program include a policy on establishing an electrically safe work condition. • Article 130 : Sections 130.1 and 130.2 have been rewrit- ten to accommodate the relocation of information from former Sections 130.2(A) to 110.3 and to keep the focus of Article 130 on requirements related to work involving electrical hazards.

The National Fire Protection Association (NFPA) recently released the 2021 edition of their 70E Standard for Elec-

trical Safety in the Workplace. The standard includes recommenda- tions for safe work practices to protect personnel by reducing ex- posure to major electrical hazards. NFPA 70E helps companies avoid workplace injuries and fatalities due to shock, electrocution, arc flash, and arc blast. And it assists

in complying with the Occupational Safety and Health Ad- ministration’s (OSHA) 1910 Subpart S and 1926 Subpart K.
