DO I NEED A POLICY RELATING TO CONDUCT AND DISCIPLINE?

Your company should have a clear policy in place that spells out what is acceptable conduct and what is not. They should also have a clear list defining what constitutes gross misconduct.

WHAT IS GENERAL MISCONDUCT?

General misconduct is likely to lead to a telling off or, following a full disciplinary procedure , a warning or the next step on the disciplinary ladder if they have already received a warning.

WHAT IS GROSS MISCONDUCT?

Gross misconduct is usually an immediately dismissible offence – something so bad that it fundamentally and terminally destroys the relationship between employer and employee. Gross misconduct will almost certainly require the employee to be suspended fromwork . Any suspension must be with full pay and is not a punishment – it should be used to protect the workforce, the accused and the company during an investigation and disciplinary process.

SUSPENSION FROM WORK

DO I HAVE TO DISCIPLINE AN EMPLOYEE IF THEY HAVE BEHAVED INAPPROPRIATELY? Sometimes if the incident is minor any disciplinary action would seem a bit heavy handed. In these cases the employee simply needs to be told what the rules and expectations are , how they have fallen short and a reminder that any further incidents may result in disciplinary action.

HOWDO I GO ABOUT DISCUSSING AN EMPLOYEE’S MISCONDUCT? All incidents should be addressed with the employee in a private meeting away from other employees. We recommend you always take advice in case your ‘concern’s breach any of your employees’ protected rights.
