SO DON’T SETTLE FOR A STONE-AGE LAW PRACTICE It’s Not 1918 I’ve always been the type of attorney who enjoys getting to know my clients. If I walk by somebody in the waiting room of our office, you can bet I’ll stop and say hello. While there’s no substitute for these face-to-face meetings, I understand that our 24/7, interconnected world doesn’t always allow for that. With advanced technology, physical distance shouldn’t be a barrier to getting the representation you need. — I recently held one while I was in Iceland, for example — and we’re always looking for new ways to implement tech to increase efficiency. Ideas that would’ve been regarded as science fiction even a decade or two ago are now genuine possibilities. I believe it’s a firm’s responsibility to use all the tools at their disposal to provide the best service for their clients.
Take videoconferencing software as an example. The very phrase sounds ridiculous, making you think you’ll need a video camera and a professional crew to participate in one. Only a few years back, that would’ve been the case. Now, the vast majority of people have a videoconferencing device on their person at all times. It’s called a smartphone. I prefer videoconferencing to traditional phone calls for a couple of reasons. First, you have the chance to pick up on the subtleties of body language that you’ll never get from audio alone. Second, it forces everyone to sit down and focus on a meeting rather than trying to chat while doing something else. You may not be able to meet in person, but you should still be fully present for our discussion. Closing this physical distance with technology is especially important because our clients’ lives don’t stop in the event of an accident. You may be in the hospital or dealing with a million other things.
Making the time to visit our office isn’t always possible. Technology allows you to get the best representation in a way that suits your needs. For us, it’s an essential component in doing our jobs as well as we can.
Our office has always prided itself on being technologically adept. We had our first website in 1996, making us one of the very first firms in the nation to be on the internet. In 2009, a few years before electronic signatures became usable on a broad scale, I had another revelation. At that time, gas was pushing three dollars a gallon. Having clients from far and wide drive to the office routinely was inconvenient and expensive. To get around this nuisance, we started sending documents, along with return envelopes, via FedEx. You might think of that as old-school now, but it was revolutionary at the time. And we’ve only taken things further since then.

Americans are looking at a new option: ditching the beaches and resorts and heading to the great outdoors. Actually, we know this option isn’t new at all. Spending time outdoors with family may very well be one of the most time-honored traditions ever. If you went to somebody’s house, you’d expect them to let you know that their stairs were broken before you rolled an ankle trying to climb them. It’s just common courtesy, right? Unfortunately, far too many stores, restaurants, hotels, and businesses don’t always alert people of the dangers lurking in their establishment. When hazardous conditions at a business lead to injuries for
unsuspecting citizens, the business should be held accountable. Cases like these fall under the category of premises liability.
The injured party in a premises liability case needs to prove three things:
1.
The property owner was aware or should have been aware of the hazardous condition.
2. The property owner was negligent in
repairing and/or didn’t provide adequate warning of the hazard.
3. The hazard directly caused the injury.
In essence, what these cases seek to establish is the property owner’s failure to make their premises safe. Of course, anyone entering someone else’s property must exercise a reasonable amount of care. Annie Duke’s ‘Thinking in Bets’
Annie Duke may seem an unlikely business consultant given that she’s best known as a professional poker player. But the lessons in her new book, “Thinking in Bets,” extend far beyond the felt. Duke, who studied psychology at UPenn and has consulted for a number of companies, takes the decision-making lessons she learned at the poker table and applies them to the hard choices we have to make in business. To emphasize the nature of her work, Duke begins with an introduction called “Why This Isn’t a Poker Book.” She writes that the process of thinking in bets “starts with recognizing that there are exactly two things that determine how our lives turn out: the quality of our decisions and luck.”
When you make a decision, you rarely have perfect clarity regarding all the factors at play. This imperfect picture is what makes every business decision risky. Duke argues that ignoring inherent risk results in dangerous outcome-based thinking. As an alternative, she proposes that you acknowledge that not every decision will be the right one. This way, you can investigate the nature of your decision-making process and improve it without being blinded by lucky (or unlucky) results. Poker provides a fertile analogy for this concept. It’s a game of imperfect information. No matter how much poker you’ve played, you never know which cards the other players hold. You can make educated inferences based on the information you gather, but there is always going to be a risk in calling a bet. The process parallels how we
decide what’s best for a company. We analyze all the information we have at hand and make a projection about the best option. Until the decision plays out, we won’t know the outcome. Though Duke knows more about poker than just about anyone, she doesn’t limit her examples to gambling. She writes with equal skill and depth about everything from CEOs to football coaches. “Thinking in Bets” is a comprehensive overview of risk assessment that provides countless tips on how to improve your decision-making. Even if you have no idea whether a flush beats a straight, you’ll find “Thinking in Bets” a valuable addition to your leadership library. Entrepreneurship requires making millions of decisions. 1. Heat oven to 425 F. 2. Rinse wings under cold water and pat dry. Season liberally with salt and pepper, and drizzle with olive oil. Roast on a baking sheet for 25 minutes or until skin becomes crisp and brown. 3. Blend butter, red curry paste, honey, and soy sauce in a large mixing bowl. 4. Toss wings in butter mixture. Squeeze lime juice on top, transfer to serving plate, and garnish with cilantro.
